Overwaarde van de huis

Ik heb een vraagje maar mijn Nederlands is niet zo goed dus moet ik in Engels schrijven om goed uitleggen. Please feel free to write in Dutch if you have any input.

We will divorce with my husband. We had signed a prenup contract before we got married. According to our contract we will share the ‘overwarde of the house’ if we get divorced. The owner of our house is my husband and he will keep living in the house after we get divorced.

My share of the overwarde bedrag of the house is € 40.000 but I don’t want to receive the overwaarde of the house. It is possible that I can give up on this right, but do I have to pay belasting for leaving my share of the overwarde of the house to my husband?

Secondly, If the answer is yes, do I need to pay belasting in the Netherlands? Because before our divorce finalized I’ll move to Japan for good. If our divorce is finalized when I am in Japan, do I pay belasting for overwaarde of house to the Netherlands?
